Reviewing Council Bylaws
Effective 9 June
Council proposed to revoke a number of bylaws no longer needed, and introduced Bylaw 215 Miscellaneous Matters to cover the remaining few points Council felt need to be retained. There were no submissions made during the consultation phase and Council approved the changes at its 29 May meeting. Consultation closed on 20 May with no submissions were received.
Which Bylaws are affected?
Council has revoked the following:
- Consolidated Bylaw 1992 (covering refuse collection and disposal, public swimming pools and miscellaneous matters.
- Fire Prevention Bylaw 1981 (No 170)
- Control of Animals Bylaw (No 185)
- Nelson Public Library Bylaw 2001 (No 201)
The new Bylaw Council is Bylaw 215 Miscellaneous Matters.
Why is the change needed?
Council undertook a clause by clause review of the old bylaws and discovered that the bulk of them are either no longer relevant, have never been used or have been superseded by other bylaws or regulations.
Council considers in the review process that any controls imposed on members of the public must be necessary, appropriate and enforced. Where a bylaw is not necessary, it should be revoked, hence the proposal.
However there were still several points that Council felt should be retained and these have been condensed into Bylaw 215 Miscellaneous Matters:
- Barbed wire fences
- Control of animals
- Slaughter of stock or poultry
- Storage of carcasses
- Keeping of animals
- Living in caravans
- Refuse disposal (Public litter receptacles, Collection of refuse)
