Council to set operative date
The opportunity for submitters to appeal Council's decision to the Environment Court closed at 5pm on Monday 12 May. No appeals were received. Council will review a report to make the Plan Change operative and set an operative date.
Background
The Commissioner’s decisions regarding Plan Change 06/04 were adopted by full Council at their meeting on 6 March and were publicly notified on Saturday 29 March. Any submitter or further submitter had an opportunity for appeal (within 30 working days of this public notification).

Further submissions closed on 25 May 2007, one further submission was received. Twenty-six (26) submissions were received during the original consultation. A hearing was held on 29 August 2007.

The Nelson City Council has resolved to amend the Nelson Resource Management Plan by way of a Plan Change, pursuant to Clause 5 of the First Schedule of the Resource Management Act 1991. The Council has resolved to proceed with notification of this plan change.
The plan change (proposed change 06/04) proposes to rezone a 5 metre strip of land adjacent to the Railway Reserve, Stoke shown on Planning Map 29 (right hand) from ‘Industrial’ to ‘Residential’. Several other amendments are proposed to ensure that the proposed provision is fully integrated into the existing planning framework.
Public participation process
The process for public participation in the consideration of the proposal under the Act is as follows: After the closing date for submissions the Nelson City Council will prepare a summary of submissions. This summary will be publicly notified; there will then be an opportunity to make a further submission in support of or in opposition to the submissions already made. A public hearing will then be held (if applicable) and Council will give its decision on the proposed change, together with its reasons for accepting or rejecting submissions. Following the Council's decision, any person who has made a submission has the right to appeal the decisions on the proposal to the Environmental Court. Following the Council’s decision, replacement pages for the NRMP will be made available online, and to subscribers.
Any person may make a submission on the proposed change, or a ‘further submission’ either in support of or in opposition to a submission.
