Resource Consents and Environment Policy

1. Resource consent schedule of charges

Under the Resource Management Act 1991 (RMA), resource consent processing, monitoring, designations and plan changes will attract an initial charge under Section 3 of this Fees and Charges Schedule where appropriate.

All disbursements, such as telephone calls, courier delivery services, all public notification costs, postage for notified applications and document copying charges will be recovered from the applicant at cost, plus administration charges.

Where resource consent processing is requested by an applicant to be outsourced, charges will be recovered from the applicant at cost plus administration charges.

Monitoring

  1. The expected number of monitoring inspections or costs will be assessed at consent issue stage and charged as part of the consent cost. Any extra work that is required to monitor compliance with the consent conditions will be charged as additional costs and separately invoiced.
  2. Resource consent monitoring charge/inspection of $100.00 per visit applies (other than where a building consent has also been issued). Monitoring charges associated with review of information required to be provided by a condition of a resource consent will be charged for at the appropriate charge out rate of the officer or specialist consultant involved.
  3. Resource consents relating to the construction of a building, e.g. site coverage, height, etc, which can be monitored at the time of building construction, will be charged at $50.00 per visit.
  4. Where the applicant is required or authorised to monitor the activity, the Council’s costs in receiving and reviewing the monitoring information will be charged directly to the consent holder at the appropriate charge out rate of the officer or specialist involved.

2. Heritage Buildings

Non-notified application to conserve and restore heritage building, place or object listed in the Nelson Resource Management Plan does not incur a charge.


3. Schedule of Charges

  1. Where an application involves multiple consents the fee or charge is payable at the higher rate.
  2. Where a subdivision consent includes additional land use consent(s) an additional charge for the land use consent(s) must be paid.
  3. Additional charges under section 36 of the Resource Management Act will be imposed on those applicants where the costs of processing consents are not fully covered by the initial charge imposed at the time of application.

New Subdivisions

Type 1 Approval

Type 1 Approval is for subdivision applications lodged as 2 steps: a deposit is required for first layout plan approval then a further charge for review of each stage prior to commencement of work. This is an option for subdivisions of 11 lots or more. It includes engineering plan checking at each stage and inspection during construction.

Type 2 Approval

Type 2 Approval is one charge required for application with both layout plan and details of each stage.

5. Invoicing

5.1 Where processing costs reach the level of the initial charge, monthly invoices will be sent to the applicant.

5.2 The Council has no obligation to perform any action on any application until the charges for the action have been paid in full; such payment will be required by the 20th of the month following invoice.

5.3 Where any interim invoice is disputed, work on processing the application will be stopped until the matter is resolved at the discretion of the Manager Resource Consents.

5.4 The option of monthly invoices only in lieu of initial charges may be available on strict credit conditions as follows:

5.4.1 The consent process, or Council involvement in the project, is likely to extend over a period in excess of 6 months; and

5.4.2 The total amount for invoices is likely to exceed $5,000; and

5.4.3 The applicant is in good financial standing with satisfactory credit record and agrees to abide by the Council's usual credit terms.

OR

5.4.4 The applicant is a regular customer of the Council's Consents Unit, is in good financial standing with no record of unpaid invoices, who agrees to pay each and every invoiced charge by the 20th of the month following the date of issue of the invoice. Any disputes relating to an invoiced charge must be resolved after the invoice has been paid. Failure to meet these criteria will result in the option of monthly invoices, in lieu of initial charges plus monthly invoices being withdrawn.

5.5 The decision on whether to waive the required charge and institute a system of monthly invoicing shall be made by the Manager Resource Consents or Divisional Manager Planning and Consents, having regard to the above criteria.
